The owner of the Wellmax.ee online shop (hereinafter referred to as the Online Shop) is Wellmax Baltic OÜ (registry code 11403020), registered office in Kurtna küla, Alutaguse vald, Ida-Virumaa, 41202, Republic of Estonia.
Term of sales contract and information about goods and prices
The sales terms apply to purchasing goods from the Online Shop.
The prices of the products sold in the Online Shop are indicated next to the products. A fee for delivery of the goods is added to the price. All the prices of the goods sold in the Online Shop are in euros.
The fee for delivery of the goods depends on the location of the purchaser and the delivery method. The delivery fee is displayed to the purchaser when the order is placed.
Information about the goods is provided in the Online Shop next to the goods.
Placing an order
To order goods, the requested goods should be added to the shopping basket. To place an order, the required data fields must be completed and a suitable method of delivery chosen. Next, the amount payable is displayed on the screen. The payment can be made in a secure manner via the following payment methods:
- Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank and Pocopay

Payments are mediated by Maksekeskus AS. Payment is made outside the Online Shop in the secure environment of the respective bank when using a bank link or in the secure environment of Maksekeskus AS when using a credit card. The seller has no access to the customer’s bank or credit card details. The contract enters into force after the amount subject to payment has been credited to the bank account of the Online Shop.
The owner of the Online Shop is the controller of personal data who transmits the personal data necessary for making payments to the processor, Maksekeskus AS.
If the goods ordered cannot be delivered because they are out of stock or for any other reason, the purchaser will be notified thereof as soon as possible and the amount paid (including the cost of delivery of the goods) will be refunded immediately but no later than within 14 days of receiving the notice.
The goods may be sent to the following countries: Estonia, Finland
To receive the goods, the purchaser has the following options: delivery by Viaexpress logistics or the opportunity to pick the goods themselves.
The delivery cost of the goods is borne by the purchaser and the respective price information is displayed next to the delivery method. The goods are delivered with a 17-metre semi-trailer, which has no hoist mechanism. A prerequisite for making a delivery is that the place of destination/site/plot is accessible by a semi-trailer. If the site cannot be accessed by a semi-trailer, a separate discussion must be held on alternative options, which are possible for an additional fee (e.g. HIAB transport).
Inside Estonia, consignments generally arrive at the point of destination determined by the purchaser within three working days of entry into force of the sales contract. Delivery outside Estonia is made within five calendar days depending on the place of destination.
Right of withdrawal
Once the order has been received, the purchaser has the right to withdraw from the contract entered into in the Online Shop within 14 days.
The right of withdrawal does not apply if the purchaser is a legal person.
To exercise the 14-day right of withdrawal, the purchaser may not use the ordered goods in any other way than is necessary in order to examine the nature, properties and functioning of the goods in the same way the purchaser would be allowed to test the goods in a physical shop.
If the goods have been used for any purpose other than is necessary to examine the nature, properties and functioning of the goods, or if they show any signs of use or wear and tear, the Online Shop has the right to lower the refundable amount in accordance with the decrease in the value of the goods. Upon returning, the goods must be in their initial form – this means that the goods may not have been processed, cut or installed and no other similar operations may have been performed with the goods.
To return the goods, the purchaser must submit a declaration of withdrawal from the purchase of the goods, the form for which can be found here, and send it to the e-mail address email@example.com no later than within 14 days of receiving the goods.
The cost of returning the goods is borne by the purchaser unless the reason for return is the fact that the product to be returned does not correspond to what was ordered (an incorrect or faulty product).
The purchaser must return the goods within 14 days of submitting the declaration or produce proof that the goods have been handed over to the carrier of the goods within said period.
Having received the goods that are being returned, the Online Shop refunds the purchaser any amounts received from the purchaser on the basis of the contract immediately but no later than within 14 days of receiving the declaration for withdrawal.
The Online Shop may refuse to provide a refund until it receives the item that is the object of the contract or until the purchaser produces proof that the item has been sent back, whichever happens first.
If the purchaser has explicitly chosen a method of delivery different from the most inexpensive normal method of delivery offered by the Online Shop, the Online Shop is not required to refund to the consumer the amount exceeding the cost of normal delivery.
The Online Shop has the right to withdraw from the sales transaction and request that the goods be returned by the purchaser if the marked price of the goods in the Online Shop is significantly lower than the market price of the goods due to an error.
Right to file a complaint
The Online Shop is liable for the non-compliance of the goods sold to the purchaser with the terms and conditions of the contract or for the defects which existed at the time of delivery of the item and which become evident within up to two years of the delivery of the goods to the purchaser. Within the first six months of the delivery of the item to the purchaser, it is presumed that the defect existed at the time of delivery of the item. The obligation to disprove this presumption lies with the Online Shop.
If a defect is discovered, the purchaser has the right to contact the Online Shop within no later than two months by sending an e-mail to the address firstname.lastname@example.org or calling +372 5919 2469.
The Online Shop is not liable for defects occurring after the delivery of the goods to the purchaser.
If the goods purchased in the Online Shop have defects for which the Online Shop is liable, the Online Shop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Shop will refund all fees incurred under the sales contract to the purchaser.
The Online Shop responds to the consumer’s complaint within 15 days in writing or in a format that can be reproduced in writing.
Direct marketing and processing of personal data
The Online Shop uses the personal data entered by the purchaser only for processing the order and sending the goods to the purchaser. The Online Shop transmits the personal data to the companies providing transport service in order for the goods to be delivered.
The Online Shop sends the purchaser newsletters and sends offers to the purchaser’s e-mail address only if the purchaser has expressed such a request by entering their e-mail address on the website and has consented to receive direct marketing messages.
The purchaser can always decline future offers and newsletters sent by e-mail, notifying us thereof by e-mail or following the instructions in an e-mail containing an offer.
Resolution of disputes
If the purchaser has complaints regarding the Online Shop, they must be e-mailed to email@example.com or communicated by calling: +372 5919 2469.
If the purchaser and the Online Shop are not able to resolve the dispute by agreement, the purchaser may bring the matter before the Consumer Disputes Committee. The procedural rules can be examined and an application can be filed here. The Consumer Disputes Committee is authorised to resolve disputes arising from the contract entered into between the purchaser and the Online Shop. The purchaser’s complaints are reviewed by the Committee free of charge.
